Terms and Conditions

The Terms and Conditions below apply to all bookings made with 'Sea Eye Group Pty Ltd' (also referred to as 'we', 'us' or 'our'). 'Sea Eye Group Pty Ltd' is a company registered under the Australian Securities and Investments Commission (Australian Business No: 90 162 892 417).

 

Our Main Office is located at Lot 3027 Quarry Road, Christmas Island, Western Australia 6798.

Please carefully read the Terms and Conditions below prior to booking.

BOOKING

  • All Bookings made with 'Sea Eye Group Pty Ltd' are subject to these Terms and Conditions.

  • Within the Vehicle type of choice, the Vehicle that Guests receive will be at our discretion.

  • All Bookings are preferred to be a minimum of 3 Days rental.

  • The terms 'You', 'Yours', 'Yourselves', 'Guest/s' and 'their' refer to the person making the booking and all Guests included under the Booking.

BOOKING THROUGH TRAVEL AGENTS

  • Travel Agents refers to any Travel/Tourism Company which book on behalf of the Guests.

  • Guests booking through a Travel Agent are subject to these Terms and Conditions, as well as the Terms and Conditions of the Travel Agent.

  • In certain circumstances at our discretion, the Terms and Conditions of the Travel Agent may prevail over ours.

RESERVATIONS

  • Reservations are preferred to be for a minimum of three (3) consecutive days. Bookings less than 3 days may be accepted in certain circumstances.

  • Reservation confirmations are subject to vehicle availability.

RATES/PRICING

  • Prices are all based on a Per Vehicle / Per Day basis, unless stated otherwise.

  • All prices are in Australian Dollars and GST Free.

  • Rates are subject to change without notice. However, rates are guaranteed based on the time of Booking.

 

INVOICING/PAYMENT (Applies to direct bookings only)

  • These terms only apply to bookings that were made directly with us.

  • Bookings made through Travel Agents are subject to their payment terms.

  • Guests are to contact us as soon as possible, if they believe that the Booking Confirmation or Invoice is incorrect.

  • Acceptable Payment Methods are as follows;

    • ​Online Bank Transfer

    • Credit Card / EFTPOS Payment (additional non-refundable 2.0% Credit Card Surcharge will apply)

  • A separate invoice will be issued to the Guest after their departure, should there be any additional charges incurred. 

  • Payment must be paid in full a minimum of fourteen (14) Days prior to arrival on Christmas Island, please allow for Bank Processing Times.

  • Payments via Credit Card can be done online via the Personalized Payment Link that will be sent along with the Invoice (All Payments via Credit Card will incur an additional non-refundable 2.0% Credit Card Surcharge).

PAYMENT UPON ARRIVAL (Applies to direct bookings only)

  • These terms only apply to bookings that were made directly with us.

  • Guests MUST notify us in advance via email - payments@sea-eye.net, should they wish to pay upon arrival on Christmas Island.

Acceptable Payment Methods upon arrival are as follows;

  • Cash Payment (MUST be in the exact amount, as staff will not be able to give change on site)

  • Credit Card (additional non-refundable 2.0% Credit Card Surcharge will apply)*

    • *Payment on Arrival via Credit Card may not always be available as only the Manager is able to accept Credit Card payments outside of the office so if the Manager is off Island, then this payment method will not be available.

COMMENCEMENT OF HIRE

  • Vehicles for all Bookings will need to be picked up at the Airport, unless otherwise specified/requested.

  • A Staff member will be at the Airport to greet Guests and handle the hire process.

  • A Vehicle Rental Agreement will need to be filled out when hiring a Vehicle from us.

    •  The Rental Agreement can be filled out prior to arrival, this will allow guests to just collect the Vehicle Key from a Staff Member after we have verified that the Driver License Details match, please request for the Vehicle Rental Agreement to be sent to you prior to arrival on Christmas Island by emailing us on contact-sea-eye.net.

    •  Keys to the Vehicle will not be handed over to Guests until they have completely filled out the Rental Agreement Form to our satisfaction.

USE OF VEHICLE - AUTHORIZED DRIVER/S

  • Guests must fill out the details for the Nominated Driver/s for the Vehicle on the Vehicle Rental Agreement

  • Guests must fill out the details for all additional Drivers for the Vehicle on the Vehicle Rental Agreement, or notify our Staff Member of all additional Drivers so that they can take an Image of all relevant Driver Licenses in the case of having more than two (2) Drivers.  

  • Guests must hold a valid Driver License that is still current and qualifies them for the particular class of Vehicle hired.

  • Guests must be over the age of 21 and hold a current and valid Driver's License to drive our Vehicles.

  • Guests holding a Learner's Permit or Provisional Plates ARE NOT eligible to drive the Vehicle.

VEHICLES ARE NOT TO BE USED;

  • On any roads which are not considered to be part of an established Track/Road.

  • To trespass onto any Mine Lease areas/zones or any prohibited and/or private areas.

  • To carry person/s for hire or reward.

  • If breath or blood alcohol concentration exceeds the maximum lawful concentration or if intoxicated/under the influence of any drug, toxic, or illegal substance.

  • To carry any inflammable, explosive or corrosive materials.

  • To carry detainees.

  • To propel or tow any vehicle (not being a trailer), or to propel or tow any trailer with a load in excess of the capacity of the trailer, towing mechanism or Vehicle.

  • To carry any greater load, number of persons or for use in a manner or for a purpose for which the Vehicle was not designed and constructed or to carry any greater number of persons than the Vehicle has seat belts.

  • To carry any animal or pet.

  • For racing, pace making, reliability trials or hill climbing, or being tested in preparation for those purposes.

  • In contravention of any criminal legislation, any legislation involving a penalty, or for any illegal purpose whatsoever.

  • In any way that is considered to be in breach of Local or State Road laws/legislation.

  • For the purpose of launching a boat or for use in locations where any part of the vehicle may come into direct contact with Sea Water.

  • By any Person/s who have not been been recorded by us as an Authorized Driver.

  • If We have directed You or any Authorized Driver not to drive the Vehicle.

RETURN OF HIRE

  • Vehicles for all Bookings will need to be returned at the Airport, unless otherwise specified/requested.

  • No Staff member will be at the Airport to handle the return of the Vehicle.

  • Guests are required to refuel the Vehicle upon return to avoid additional charges.​ ​

  • Please leave the Vehicle Key in the Ignition and the Vehicle unlocked within the Airport Car Park or designated return area.

  • Please take all personal belongings with you, as any belongings will be disposed of upon cleaning the Vehicle.

Monday - Friday:     09:30am - 12:00pm

 01:30pm - 3:30pm

Weekday After Hours:       04:00pm - 06:30pm

       Weekends:       10:30am - 06:30pm

  • Please be aware that it may take up to 24 hours for a staff member to reply to emails, we ask that you be patient. If it is urgent, please contact the number on the Vehicle Rental Agreement.

  • Our Staff/Mechanics do not work on Weekends (Saturday/Sundays) or Public Holidays, so please expect delays should you require Staff Assistance during these days.

  • We DO NOT provide 24 hour assistance, so please be aware that you may not be able to contact a Staff Member depending on the time of contact.

MECHANIC ASSISTANCE

  • We DO NOT provide 24 hour assistance, so please be aware that you may not be able to contact a Staff Member depending on the time of contact.

  • Please contact us in the event of the following;

Flat Tire

  • If possible, we will send a Mechanic to the Vehicle's location to fix the Tire.

  • Expect delays due to travel times depending on the location of the Vehicle.

  • Further delays will occur depending on the following;

    • Outside of Work Hours

    • Weekends (Saturday/Sundays)

    • Public Holidays

    • Availability of Mechanics 

Breakdown

  • If possible, we will send a Mechanic to the Vehicle's location to fix the issue.

  • Expect delays due to travel times depending on the location of the Vehicle.

  • Further delays will occur depending on the following;

    • Outside of Work Hours

    • Weekends (Saturday/Sundays)

    • Public Holidays​

    • Availability of Mechanics

 

*If any issues occur on a Weekend or Public Holiday when our Mechanical Staff are not working, we may not be able to fix the issue until the next          Business Day.

 

VEHICLE REPLACEMENT

Should Guests require a Vehicle replacement due to our Mechanics being unable to fix the issue on the spot or a major issue with the Vehicle. We will offer a Replacement Vehicle, however this will be heavily dependent on the availability of our other Vehicles.

SPECIAL REQUESTS

  • While we will try and satisfy the requests of Guests to the best of our ability, please be aware that not all requests can be accommodated.

  • Please inform us of any special requests at the time of booking (minimum of 14 days prior to arrival).

  • Guests are required to bring their own Baby/Child Seat, as we do not supply these nor have them available.

  • Our Vehicles are not suitable for Rear Facing Baby Seats as they lack the necessary anchor points.

SMOKING

  • Smoking is strictly NOT permitted inside of the Vehicle.

  • Smoking of all types is NOT permitted (Cigars, Cigarettes, Electronic Cigarettes, Vapes and etc).

  • Smoking in the Vehicle will result in a $350.00 AUD Penalty charge.

  • If any charges for Smoking apply, it will be charged within 7 days after the Guests Departure. 

  • Smoking Penalty charges will be incurred to the Guests in the following circumstances;

    • Strong scents associated with Smoking are reported to Management. (Manager will then confirm the report and if the Scent of Smoking is confirmed, the Smoking Penalty will be charged)​.

    • Physical evidence of Smoking is found inside the Vehicle (Burnt Cigarette butts, Cigarette Ashes, Burn marks resulting from Cigarettes).

  • Smoking Penalty Charges will still apply to the Guests even if the Guest in person does not smoke (Friends/Visitors/Hitch-hikers of the Guests smoke within the Vehicle) *To avoid this additional charge, please ensure that Friends/Hitch-hikers DO NOT smoke within the Vehicle*

FLIGHT DISRUPTIONS

'Sea Eye Group Pty Ltd' is not responsible for any changes/cancellations that arise from delays or disruptions that occur at the Guest's point of origin, point(s) of connection or point of arrival due to operational requirements by the airlines or inclement weather. We recommend that Guests purchase comprehensive Travel Insurance when travelling to Christmas Island, in case of disruptions which result in Changes or Cancellations of the Bookings.

In circumstances where the commencement date of hire is changed due to Flight Cancellations arising from Qantas's Operational requirements or inclement weather, the Booking shall remain valid until the date of advised Flight Recovery by Qantas Airlines and will not be considered as a "No Show", however costs for the loss of day/s WILL NOT be refunded.

EXTENSION OF HIRE DUE TO FLIGHT DISRUPTIONS

In the case where Guests would like to extend the hire of the Vehicle due to flight disruptions either arising from Qantas's operational requirements or inclement weather, Vehicle Hire may be extended depending on the availability of vehicles/approval from us. Clients will be charged the full daily Hire Rate depending on the Vehicle type starting from the day that they re-hired from the Airport until the date the vehicle is returned.

CANCELLATION/MODIFICATION DUE TO FLIGHT DISRUPTIONS

If clients would like to cancel or modify their vehicle booking as a result of Flight Disruptions either due to Qantas's operational requirements or inclement weather preventing their arrival on Christmas Island, they MUST notify us of the cancellation/modification within 24 hours of the original start date of hire. There will be no additional charges to modify the booking but modification confirmations will be highly dependent on the availability of vehicles.

No refunds will be given for these type of cancellations, it is recommended that clients purchase comprehensive Travel Insurance.

DAMAGE TO VEHICLE

  • Damage to Vehicle consists of any damage deliberately/accidentally caused by Guests to our Vehicles within the period of hire. (excludes general wear/scratches/minor dents from normal usage)

  • Guests are required to promptly report to us and the Police or other relevant authority, and in any event within 24 hours, any incident involving damage to the Vehicle or any other property or injury to any person.

  • Failure to contact us, the Police or other relevant authorities within 24 hours in the event of damage to our vehicle or any other property or person/s, may make the Guest liable for the costs of all damages.

  • Guests shall be responsible for the first $2,500.00 AUD of any damage to the vehicle, subject to our Insurance Company's Policy.

  • In the case of major damages exceeding the first $2,500.00 AUD, the Guests may be required to pay the full amount, if damages have occurred to our vehicles as a result of neglect, carelessness or driving under the Influence or against the Terms and Conditions listed at the back of the Vehicle Rental Agreement.

  • If any charges for Damage to the Vehicle apply, it will be charged within 7 business days after the Guests Departure.

Damages to our Vehicles - Costs

  • The Full Cost to replace/repair any damaged parts of our Vehicle.

  • $95.00 / Per Hour - Mechanic Labor Costs to replace/repair damages.

 

Damages to any other Property or Person/s​​

  • Guests are required to settle all associated compensation costs for any damages to the property or person/s directly with the owner of the property or the person/s involved. 'Sea Eye Group Pty Ltd' hold no responsibility for compensating/communicating on the Guests behalf.

LOSS OF PROPERTY

  • Loss of Property consists of losing/taking items which was supplied by us when hiring the Vehicle.

  • Guests are required to promptly report to us and the Police or other relevant authority, and in any event within 24 hours, any incident involving loss to the Vehicle.

  • If any charges for Loss of Property apply, it will be charged within 7 business days after the Guests Departure. 

  • Should the Guest lose the Key to the Vehicle, they will be charged $250.00 AUD for the replacement of the Key. 

ADDITIONAL COSTS - REFUELING

  • Our Vehicles are hired out with a full tank of fuel, Guests who fail to refuel the vehicle upon return will incur the following charges;

    • $15.00 AUD - Refuel Charge + $6.00 AUD / Per Liter of Fuel short of a full tank.

  • In the circumstance where we had hired out the vehicle with less than a full tank of fuel, Guests are to refuel the vehicle to roughly the same amount that was present on the commencement of hire.

  • In circumstances where Guests are unable to refuel the vehicle due to the Fuel Station being closed, Guest will be charged $3.30 AUD / Per Liter of Fuel short of a full tank. 

  • Invoicing for the Refuel Charges will be sent to Guests approximately 1-3 business days after the Guests date of departure.

NO-SHOW POLICY

  • No-Show refers to Guests who have a valid booking with us but do not end up showing up at the Airport to pick up their vehicle on the date of Arrival.

  • In the case of failure to notify us of a Cancellation prior to the arrival date, the Booking Amount may not be eligible for refund.

  • Guests booking through a Travel Agent are subject to their No-Show Policy.  

  • Guests who fail to show up on the day of arrival will be charged for the full amount of the Booking and are not entitled to a Refund.​​

CANCELLATION POLICY - Effective as of 01/06/2022

  • In the case of failing to notify us of a cancellation prior to the arrival date, the Booking Amount may not be eligible for refund.

  • Guests booking through a Travel Agent are subject to their Cancellation Policy, which may prevail over ours.

    • 0 - 7 Days Cancellation Notice: Full Price of the Total Booking Amount will be charged (No Refunds given).​

    • 8 - 14 Days Cancellation Notice: 50% of the Total Booking Amount will be charged (50% Refund given).*

    • 15+ Days Cancellation Notice: Full Amount for the booking will be refunded.*
      *For payments via Credit Cards, the 2.0% Credit Card Surcharge is non-refundable (applies to direct bookings only).

MODIFICATIONS TO TERMS AND CONDITIONS

  • 'Sea Eye Group Pty Ltd' reserves the right to modify these Terms and Conditions without prior notice.

  • Modifications to the Terms and Conditions will be valid and effective immediately as of the time it is posted.

  • Unless stated otherwise, the updated Terms and Conditions will apply to all Guests who have current Bookings and to Guests who have booked with us through Travel Agents.
